The Constitutional Court of the Russian Federation’s contribution to the development of local self-government: current aspects of constitutionalization

Abstract

The article explores the contribution of the Constitutional Court of the Russian Federation to the development of the constitutional foundations of local self-government. The relevance of the topic is due to the need to identify the most significant decisions of the Constitutional Court of the Russian Federation that develop the constitutional content of the nature of local self-government, the principle of the independence of local self-government, and the collective right to exercise local self-government.

The purpose of the study is to assess the role of the decisions of the Constitutional Court of the Russian Federation in the constitutionalization of the legal foundations of local self-government and the creation of the necessary constitutional basis for the development of local self-government institutions.

The methodological basis of the study is based on the use of general scientific (system analysis and dialectics) and special methods of cognition (formal-legal and comparative-legal).

The main results of the study consist in making a greater certainty in the legal understanding of the nature of local self-government as an institution of public authority, the limits and guarantees of the independence of local self-government, and the legal forms of the implementation of the collective right to exercise local self-government.
